Domestic violence is any assault, aggravated assault, battery, aggravated battery, sexual assault, sexual battery, stalking, aggravated stalking, kidnapping, false imprisonment, or any criminal offense resulting in physical injury or death of one family or household member by another family or household member. Unfortunately, domestic violence is falsely alleged by one party against the other as a tactic for that party to have an advantage over the other party in a dissolution of marriage case and can be utilized to falsely remove one party from the marital home. However, in many situations the allegations of abuse are true and accurate and must be pursued in order to protect one party and/or minor children.
