Prenuptial Agreements
Prenuptial Agreements are complex contracts. However, Prenuptial Agreements do not determine child support obligations or other child(ren)’s issues. Prenuptial Agreements, similar to Postnuptial Agreements, carry numerous requirements, including but not limited to: each party providing full financial disclosure; no fraud or duress by either party; and each party having independent legal representation for the drafting and execution of the Agreement. Prenuptial Agreements must be consistent with the provisions in your Will and/or trust documents so it will necessary that this has been done. A Prenuptial Agreement must be substantially fair with good consideration in its terms as well as the way it was negotiated and executed in order for it to be valid and enforceable. It is prudent for the Prenuptial Agreement to be executed no later than 30 days prior to the date of the marriage.
